Many owners wait for the lease to end before putting their apartment up for sale, convinced that a rented property sells less well. That is often wrong — and sometimes even the opposite is true.
Selling vacant or selling occupied: two different strategies
A property sold vacant (without a tenant) appeals to two types of buyers: future occupants and investors. A property sold occupied (the lease continues with the new buyer, who becomes the new landlord) appeals only to investors — but that is not necessarily a problem: in Paris, investor demand for already-rented properties is strong, precisely because it eliminates the uncertainty of finding a first tenant.
The tenant's pre-emption right (droit de préemption): when does it apply?
This is the point that worries owners the most, and it deserves to be clarified. The tenant has a pre-emption right in specific situations, in particular when the landlord gives them notice to vacate for sale (congé pour vendre) at the end of the lease. On the other hand, a sale “with the lease attached” — the apartment stays rented, the buyer simply stepping into the landlord's position — does not in principle have to trigger this pre-emption right, since the tenant is not being put on notice to leave the premises.

- Secure the preliminary sales agreement (compromis de vente) by clearly stating that the lease continues and that the security deposit is transferred to the buyer.
