Guaranteed rent in Paris: tourist subletting or professional tenants — the question to ask before you sign
Type “guaranteed rent Paris” into Google: the first results are comparisons of Airbnb concierge services. Yet the same term, “guaranteed rent,” covers two opposite businesses. And the answer to a single question — who does the operator rent your apartment to? — changes your legal risk, your co-ownership (condominium) situation and your peace of mind.
One term, two models
Take a comparison of Airbnb concierge services in Paris published on August 22, 2026 and updated on September 16: of the seven concierge services compared, five charge a commission (15 to 20% excl. VAT, 20% net, or from 20%) and two offer a fixed monthly rent. Guaranteed rent is thus filed among the Airbnb offers. Yet under the same label, two models coexist:
- A fixed rent in exchange for tourist subletting: the operator pays you a fixed amount, and rents your apartment to travelers, by the night or by the week;
- A fixed rent in exchange for renting to professionals: the operator rents to employees on assignment or on a job transfer, to executives on business trips, under a mobility lease (bail mobilité) or a standard furnished lease, for stays of several months.
For you, the amount paid may be identical. The risk is not.
Why the answer changes your risk
In Paris, tourist rental is one of the most heavily regulated activities in France:
- Primary residence: the City of Paris limits rental to 90 days per year since January 1, 2025, instead of 120 (City of Paris);
- Other dwelling: tourist rental of a dwelling that is not the primary residence is subject to a change-of-use authorization (autorisation de changement d'usage), and municipalities may cap the number of authorizations in certain areas (Ministry of Ecological Transition);
- Penalties: up to €5,000 in fines for failing to file a declaration where one is required, and up to €10,000 in civil fines for exceeding the annual cap (Service-Public.gouv.fr, page verified on May 21, 2026);
- Co-ownership: the co-ownership rules drawn up since the law of November 19, 2024 must specify whether furnished tourist rental is permitted; for existing co-ownerships, a ban becomes possible by a sufficient majority rather than unanimity.
An operator that sublets your apartment to tourists falls within this framework. The question is not whether it promises to handle it, but who holds the authorization and who bears the fine in the event of an inspection. With an operator that rents to professionals, the stay is a medium-term residential stay: the mobility lease, for example, lasts from 1 to 10 months and remains a residential lease (ANIL).

Six questions to ask before signing
- Who do you rent my apartment to, and for what lengths of stay? Tourists, professionals, students: ask for a written answer.
- Under what regime? Tourist rental (registration number, possibly authorization) or residential lease (mobility, furnished).
- Who holds the change-of-use authorization, if it is required, and who pays the fine in the event of an inspection?
- What do my building's co-ownership rules say about short-term furnished rental?
- Who is my tenant on the contract — the company, with what accounts and what insurance? — and what happens at exit (move-out inspection, restoration of the apartment)?
- Can I read the contract before committing? A serious operator provides it without conditions.
