Rent control: what happens on November 25, 2026?
Rent control in Paris is an experiment: by definition, it has an end date. That date is approaching — November 25, 2026 — and Parliament has not yet ruled. Here is the state of play as of October 2, 2026: what is settled, what is under discussion, and what an owner can do in the meantime.
What is settled
- The date. The experiment was created by Article 140 of the ELAN Law of November 23, 2018, then extended by the 3DS Law of February 21, 2022 “until November 25, 2026” (ANIL).
- Paris. Rent control came into force there on July 1, 2019 and has been renewed since by prefectoral order (arrêté préfectoral). The latest dates from June 12, 2026 (ANIL); the 2026 renewal is published by DRIHL.
- Without a new law, the experiment ends on that deadline.
- Current penalties. In case of non-compliance, the prefect can impose a fine of up to €5,000 for an individual and €15,000 for a legal entity (ANIL).
What is under discussion
A bill “to restore trust and balance in landlord-tenant relations” was examined by the National Assembly in December 2025 (committee on December 3, public session on December 11). Its Article 1 makes the experiment permanent. It also caps the rent supplement at 20% of the reference rent and increases the fines (National Assembly).
That leaves the Senate. According to Paris City Hall, the text is to be debated there starting October 21, 2026. Its deputy mayor for housing says the minister has committed to renewing the scheme “for two years” (franceinfo). These are statements of intent, not a passed text.
Three possible scenarios
These are not forecasts, but the three outcomes the calendar leaves open:
- Permanent status: the text passed by the Assembly is adopted, possibly amended. The caps remain in place long term, with a capped rent supplement and stronger penalties.
- Limited renewal: a two-year extension in the current areas. The status quo, pushed back by two years.
- No law in time: the experiment lapses on November 25. We are not aware, to date, of any text specifying what would happen to leases in progress: do not build any strategy on this assumption.
Our view. As long as the experiment runs, the caps set by the June 12, 2026 order apply. Betting on the end of rent control to set a rent above the cap is a bad calculation: the tenant can challenge it, and exceeding the cap exposes you.
How the cap is set today
Each year, the prefect sets by order reference rents, capped reference rents and reduced reference rents, according to the number of rooms, the construction period and whether the dwelling is furnished or not (DRIHL). The capped reference rent serves as the ceiling. As long as the experiment runs, a lease that is signed must therefore comply with the June 12, 2026 order, whatever the signing date up to November 25.
What to do in the meantime?
- Set your rent within the cap in force: capped reference rent according to the sector, the number of rooms, the construction period and whether the dwelling is furnished or not. The full mechanism is detailed in our guide to rent control in Paris.
- Watch the rent supplement: since August 18, 2022, no rent supplement can be applied when the dwelling has certain defects listed by law (ANIL).
