Rent control in Paris: the owner's guide for 2026

Since 2019, Paris rents have been capped. Many owners put up with this rule without really understanding it — and sometimes leave money on the table, or take risks without knowing it. Here is what to remember in 2026.

The principle: a reference rent by neighborhood

In Paris, rent control applies to nearly all residential rentals as a primary residence: unfurnished rental, standard furnished rental and mobility lease (bail mobilité). Every year, the prefecture publishes reference rents per square meter, defined by neighborhood, construction period, number of rooms and whether the dwelling is furnished or not.

Three amounts frame your rent:

  • The reference rent: the median value observed for a comparable dwelling;
  • The capped reference rent (+20%): the ceiling your rent excluding charges must not exceed;
  • The reduced reference rent (−30%): the floor below which a tenant can request a reassessment.

The reference rent applicable to your address can be looked up on the DRIHL / Île-de-France prefecture website. Since the amounts are reassessed every year, always check the schedule in force on the date the lease is signed.

The rent supplement: the exception that is often misused

You can exceed the cap only through a rent supplement, reserved for dwellings with exceptional comfort or location features compared with comparable dwellings in the same neighborhood: a remarkable view, a terrace, unusual ceiling height, high-end fittings…

Beware: the rent supplement must be justified and stated in the lease, and the tenant can contest it in the first months of the lease. Since the 2022 law, it is also ruled out for dwellings with certain defects (shared toilets on the landing, poor insulation, a dwelling in energy class F or G…). A poorly justified supplement is the leading source of disputes before the conciliation commission.

What an owner who exceeds the cap risks

A rent above the cap is not just a theoretical risk. The tenant can refer the matter to the departmental conciliation commission and then to the judge to obtain a reduction of the rent and reimbursement of the overpayment. The City of Paris has also set up a reporting system, and the authorities can impose an administrative fine on a landlord who fails to bring the rent into compliance.

Good to know: rental listings must state the capped reference rent and the amount of any rent supplement. A non-compliant listing already exposes the landlord to a penalty.

Rentals exempt from rent control

Rent control targets residential leases as a primary residence. Notably excluded are:

  • Rentals to companies that house their employees on assignment (ordinary-law lease signed with a legal entity);
  • Rentals that are not the occupant's primary residence (pied-à-terre, temporary company-provided housing…);
  • Seasonal rentals and tourist furnished rentals (meublés de tourisme) — which are, however, subject to other strict rules (registration number, day limit for a primary residence, change of use (changement d'usage) for a secondary residence).

  1. Check your current rent against the capped reference rent for your neighborhood — especially before a renewal or a re-letting.
  2. Document any rent supplement: photos, precise features, comparison with the neighborhood.
  3. Take care with your listings: mandatory mentions, exact amounts.
  4. Look at the legal alternatives if the cap heavily penalizes your property: mobility lease, rental to a company, or guaranteed rent through a specialized operator.

Rent control is here to stay — the scheme has been renewed and extended since its creation. Putting up with it is not inevitable, however: for a well-located apartment, renting to professionals on the move often allows an income above the rent control cap, entirely legally.
